I think good news for all!
I has just find in another us microstock site a contract were is cited the same our tax question:
http://ideas.veer.com/group/marketplace/discussions/96
read along until these words:
"Certain contributors (those who are not the rights holder – see below) will need to provide a US Taxpayer Identification Number (US TIN) on Line 6 of Part I before any treaty claim can be respected."
So if we are the rights holder of our images seems that the IRS should not be apply to us!
Right?!
I hope that may help... |

Yes - apparently ITIN is not required if you reside in a country with a witholding tax treaty!
Hopefully that can alleviate the concerns of many contributors here. |

Yes I found it as well. The text says:
Good news! As long as you are the Rights Holder and from a treaty country – you do NOT need a US Taxpayer Identification Number to claim treaty benefits. Sweet!
If you are from a treaty country and you are NOT the Rights Holder, you will need a US Taxpayer Identification Number (US TIN) to receive treaty benefits.
Even if you are from a non-treaty country, as long as you are the Rights Holder you also do not need a US Taxpayer Identification Number.
If you are unsure if your country has a tax treaty with the United States, check this list.
If you need a US TIN for yourself or your business, you can request one from the IRS. Individuals should apply for a US Individual Taxpayer Identification Number (US ITIN) by completing and filing Form W-7. Companies should request an Employer Identification Number (EIN) by completing and filing Form SS-4.
The question is, which of this company or SS is interpreting the law correctly? SS allegedly has some 'lawyers' looking at the issue. Would this other company just dream up the above or is it fact?
Would be good if the above info is correct, then we can live in peace. We obviously hold the rights to all our work - maybe the SS lawyer overlooked this fact?
SS please advise. |

Hi from the UK well this could be good news and could be the difference between many staying or going ...
do not have a problem with filling in some forms however like many do not wish or intend to apply for a US TIN number
Thanks for the info |

In the case of that particular agency mentioned above, all I had to do was fill out the W-8BEN form online (my vital statistics/ address already conviniently filled out for me on the form), check a few boxes (additional explanatory notes for further explanation were available if needed) and hit "submit".
It was all so quick and easy! |

Don't do anything till admin announces the next step. They are busy investigating this whole matter and assured us that no tax will be deducted for June sales. So just sit tight and wait for the next information.
