Admin,

I am from non treaty country, do i need to fill up this W-8BEN form?

If yes, below are what i plan to submit, is this correct?

part I
1. Name
2. leave empty
3. Select Individual
6. leave empty
7. leave empty
8. leave empty

part II
9. leave it as it is
10. leave it as it is

part III
11. leave empty
part IV: signature

Should I have to submit the W-8BEN form?

If I don't submit it, what will happen?

Also a question I am sure a lot of people are asking.
WHY should A NON AMERICAN living outside America have to pay American tax?

If you do nothing, the 30% withholding will apply from US-based downloads.

No benefit at all if you are in a non-treaty country.

Even when I move back to a "treaty" country I probably won't bother with it, because the loss to me seems to be about 5% of my monthly income and the cost of processing it may well outweigh the saving.

You did not answer the rest of my question.
Why should a non American living outside the USA pay American taxes?

And another question is why are my other stock agents not asking for the same information??

I am not a company official so this is not an SS statement but having followed the discussions on this I am pretty sure that this is roughly correct:

First question: The reason is that US law (apparently) requires US companies to pay tax on sales made in the US on behalf of a foreign entity. So Shutterstock believes it will break the law if it doesn't do this.

Second question: The US law is complicated, it doesn't apply to agencies not based in the US (some agencies are Canada-based, for example) and within the US there still seem to be differences of interpretation. SS is applying the regulations in accordance with the legal advice it has received.

I deal with two US based trad agencies and both of them deduct tax from me. It's an unfortunate business cost of doing business through a US agent.

And surely Israel has a tax deal with the US that would exempt you from this?
