Who do I contact about this matter?

I found my image in use by someone passing it as her own. And she has licensed prints of it all over

http://www.buy.com/prod/patricia-pinto-aged-tree-i-12-x-12-poster-print/221052180.html

My image

Now she can not say she took the same image herself because I superimposed the two images and they line up perfectly. And I can still see some of my added texture lines in her image. She just added more texture.

Texture lines

What can I do about this?

You should definitely write to support@shutterstock.com and report this. You have 100% proof right there.

Also you may wish to check out this article in Shutterbuzz: http://www.shutterstock.com/buzz/tips/protecting-your-content

Good luck!

This would probably be a better address to use to contact Shutterstock. It is used for improper use of images.

infringementclaims@shutterstock.com

Here is the link to the thread on this.

I would contact her directly and tell her she cannot resell your image and give her the opportunity to remove it. You will probably have more success that way. If not then you always have the option of other avenues. Her email is here:

patricia@pintopatricia.com

Her website indicates she is a professional artist, sculptor and illustrator - not the usual scum bag type that simply steals images and reposts them for sale as their own.

Her web site is here:

http://pintopatricia.com/

You might want to also consider she might have used your image as the basis for her artwork not knowingly thinking she was contravening any best practice.

maybe they bought a license to reprint your image.
lots of buyers use stock images for a raw basis for derivatives then resell as prints, or on calenders or coffee mugs.

From the product page:

Quote:
This licensed image was printed on premium heavy stock paper and is ready for framing or hanging.

It sounds like she believes the image is appropriately licensed for this use. Could it be?

I'm dealing with a very similar issue. I just found one of my images altered and for sale on another stock site. I contacted Shutterstock and they said they are investigating it...thank goodness. It was so discouraging to find though. I think they would remove it if I contacted them (because, besides the fact that I own the copyright, it involves a child's picture which they don't have a model release for). However, the site shows that between the two versions they have available, they have received almost 2000 hits, which makes me think they've already sold many. I'm not sure I would be satisfied with just having it removed.

I'm curious about how you plan to resolve your issue and what advice anyone might have for me.

Oh my gosh, she's a fabulous artist if you take the time to look at her stuff. Especially her horses!

I'm sure she feels quite the way we all do concerning copyright, being a pro fine artist. I'm guessing she is a member of Shutterstock or another site where you have the image and purchased it.

I don't think the manner in which she got hold of the image or how good of an artist she is give her the right to sell any version of your image as her own. If she were concerned about copyright, she wouldn't have violated someone else's. Besides, I prefer your original by far.

True, I missed that she was selling them as her own art. That is just plain wrong and makes all of her work suspect!
