Please note that we have updated the Standard and Enhanced Terms of Service for our subscribers. An archive and the new contracts can be found here:

http://www.shutterstock.com/license_index.mhtml

There is a corresponding use grid for convenience, located in our FAQ -- it's the second question from the top. The direct link to the grid is here:

http://www.shutterstock.com/license_comparison.mhtml

We now also have a Website Terms of Use, which governs all site visitors regardless of if/what they purchased:

http://www.shutterstock.com/website_terms.mhtml

The Submitter Terms and Conditions will be updated soon -- we will notify you when the time comes.

As always, we thank you for your great submissions and we look forward to another year of growth and progress in 2008.

Sincerely,

Shutterstock

Persuant to the current "SS Website Use" TOS, it states:

"11.You may not frame or hotlink to the Shutterstock website or any Image without the prior written consent of Shutterstock. "

Question,...is it now necessary to obtain "Written Permission" from SS to utilize the referal links used from our personal websites in accord with the Referrant Program?

Thanks

What is about posting images in non-shutterstock forums? Is hot-linking allowed or not? SY

I will sometimes include one of my photos in a blog that is a direct link to my portfolio here to drive traffic. Will that still be allowed?

hmm,i think the changes mentioned so far apply only to subscribers, but would also appreciate any clarification.

has anyone else done the mice-type reading to see other changes (wouldn't it be nice if SS posted "changes" as highlights as others often do?)

The section of Submit.Shutterstock.com entitled Create Your Mini-Gallery, constitutes Shutterstock's prior written consent to link to your own Shutterstock Images.

I have/ run/ own a pretty active, international and independent forum, until now our members posted their best-selling/ most popular etc image on Shutterstock in our threads. Can we continue to do so? At the moment I have asked that they don't do it and advised the moderators to look that nobody hot-links to Shutterstock. Where can I get the previously mentioned permission and how do I have to proceed? Thanks, SY

WRT linking to Shutterstock, the following may be of interest:

http://www.chillingeffects.org/linking/faq.cgi

Apart from that, I would think that participation in a Shutterstock-sponsored referral program would imply that Shutterstock has provided prior written consent to link to the site using any valid referral link.

The problem is the bandwidth usage/ theft, if we hot link on our forum images that are hosted by Shutterstock then Shutterstock pays for the bandwidth to display said images on a independent forum, not me. Hot linking can strain a server considerably = a lot of bandwidth used, but it also gives Shutterstock a lot of advertising because all the images carry still the SS logo and, if I am not completely mistaken, still count as a backlink for google. But as I stated before, I prefer to be legal and safe with the forum, then superficial and sorry, SY

Right, no argument there. I was just commenting on basic links, i.e., regarding the referral question posed by mneale, and the Website TOS ("You agree not to... link to... the Site or any or [sic] the Content"). I also prefer to be "safe" and am considering shutting down a blog that I use for posting referral links, but that is exactly the point behind "chilling effects"...

Posting referral links should be fine! My problem are 280+ forum members posting their "best-selling image on Shutterstock" *sigh* SY

Shutterstock submitters may continue to link their own images to your forum.
